Government Takes On Kilmar Abrego Again

Kilmar Abrego García is once again in the eye of the storm; the United States Department of Justice has requested the reinstatement of the criminal charges. This request against the Salvadoran citizen was filed before the United States Court of Appeals for the Sixth Circuit with the aim of overturning a previous ruling that described the judicial process as an act of institutional vengeance.

Abrego García was deported by mistake in 2025 and since then has faced the Donald Trump administration, winning some of the legal battles. He is charged with human trafficking and illegal transportation of immigrants following a traffic stop in Tennessee in November 2022.

However, after all the controversy, it is noteworthy that in the American legal system there is the accusation of “vindictive prosecution.” This technical term describes situations where the government prosecutes a person not for a solid crime, but as punishment for having exercised his legal rights or having won a lawsuit against the state.

Abrego García’s lawyers point to the government’s stance as erroneous and speak of directives that come from the White House. For now, it remains to be seen which direction this case will take, while ICE has not let up on deporting the Salvadoran to Liberia, a country with which he has no ties and that many say the government intends to use to punish him.
